TERMS AND CONDITIONS
The Terms and Conditions shall be read as a part of all Online Travel Agency agreements previously communicated to Guest. In regards to these terms and conditions, I acknowledge that I have read and agree to abide by the conditions set forth in this Rental Agreement and all policies, regulations, and rules set forth by Host. I further understand and agree that to breach any items contained within the above referenced documents will result in my eviction without refund. I understand that Host has made every effort to provide accurate information, however, in the event of errors, omissions, any changes by Host, I agree not to hold Host responsible or liable.
TERMS: The following definitions will apply within this Agreement: “Agreement” refers to the Terms and Conditions outlined within this document, as well as the confirmation of Reservation details above. “Owner” refers to the actual persons or entity on the deed of the Property. “Host” refers to AZ Vacation Home Concepts LLC, a limited liability company duly organized and existing under the laws of the State of Arizona, having its administrative place of business at 4724 E Via Montoya Dr Phoenix Az 85050 “Guest” refers to all person or persons occupying the Property; and “Property” refers to the real property, its contents and related amenities rented to and being used by the Guest, interior and exterior.
“Property Deposit” refers to the initial deposit for Guest’s stay, paid to Host or an OTA. “Security Deposit” refers to the $1,000 deposit for damages and neglect by the Guest. “OTA” refers to the Online Travel Agency in which the Reservation was booked by the Guest. “Reservation” refers to reserved time the Guest stays on Property and associated costs. “Additional Services” and “Amenities” refers to pool heat and heaters, spa heat and heaters, early check-in, late check-out, grocery shopping, and additional sleeping accommodations. “Appliances” refer to pool and it’s associated equipment, spas and their associated equipment, all kitchen appliances, laundry machines, television sets, and thermostats.
Our vacation homes are available for guests to enjoy and experience Phoenix, AZ. Please bear in mind that the home you reserve is located in a community with many year-round residents. In order to ensure the quality of our homes; and the peace and quiet of our neighborhoods, all occupants must adhere to the following Guest code of conduct outlined as Terms and Conditions.
Guest acknowledges that "Host" is a licensed Real Estate Professional in the state of Arizona.
PROPERTY DEPOSIT: A 50% Property Deposit of the total Reservation, tax and cleaning fee is required to confirm the reservation by AZVH direct bookings and some OTA’s, other OTA’s require a 100% full payment. The balance, including the Security Deposit, is due 60 days prior to arrival.
SECURITY DEPOSIT: A $1,000 Security Deposit is due at the time of booking and will be returned within 14 days of departure, less any costs associated with damages, mess, and additional cleaning fees incurred by Guests after departure. Paying a Security Deposit does not relieve Guest from requirements outlined in this Agreement.
PAYMENT POLICY: All Reservations made within 60 days of arrival are due in full to confirm the Reservation. 100% payment may be required at the time of booking for special events and holidays (ex. Christmas, Easter, the month of March). Failure to pay remaining rental balances within 60 days will result in automatic cancellation of your reservation. We accept checks for U.S. funds, or credit cards (Visa, MasterCard, PayPal Venmo and Zelle). All Additional Services must be paid 7 days prior to Reservation check in date. If not paid in advance, Additional Services will not be offered or will be charged at a premium, if Guest still wants to add.
ADDITIONAL FEES: All ancillary charges and fees are subject to local taxes.
If not paid in advance, all extra charges will be deducted from your Security Deposit, then charged to the Guest if maximum funds are retained. Guest authorizes the Host to charge the card on file for the following charges, if applicable:
- All Guests are required to purchase $79 property Insurance in addition to Reservation amount (this is included in Rent if booking through Airbnb)
- Additional Guests: $25 per guest per night over 8 Guests. Unauthorized additional guests: $50 per guest
- Excessive trash (including trash that does not fit in bins): $50 minimum + dump fee + hourly transportation charge
- Excessive cleaning (above basic cleaning of linens, towels, kitchens, oven/stove, floors and bathrooms- this includes makeup stains/stained linens): $50 per hour
- Animal waste on Property from authorized pets: $75 minimum
- Unauthorized animal on property: $500/animal + damages
- Displaced furniture (>10 feet from stage point): $75 minimum
- Pool and Spa heat (see terms under POOL/SPA HEATING)
- Early check-in: $25 per hour (4 hour maximum) with prior written approval
- Late check-out: $25 per hour (3 hour maximum) with prior written approval
- Unauthorized Late check-out: $75 minimum per hour + cleaning fees and rescheduling fees UP TO an additional night, without authorization to stay overnight
- Failure to complete check-out checklist entirely: $100
- Extra twin bed(s)/cots/air mattresses: $100 per extra twin bed for length of stay
- BBQ grill: $50 minimum for extensive BBQ grill cleaning, full cost of repair (parts + labor) for any damages caused by Guest
- Thermostat & Pool Equipment: $200 minimum for any damages caused by Guest or excessive electricity/gas bills due to Guest negligence or tampering. Please group text (623)217-1719 and (480)215-4411 for assistance, we are happy to help.
- Unpaid extra nights for extended stay or early arrival date are charged the premium nightly rate. Once requested, there will be no refunds for these services.
REFUNDS/GUEST CHANGES & CANCELLATIONS: a disturbances, acts of God, Guest neglect, Guest tampering, Guest failure to vacate, or other reasons beyond its control. Host agrees to reimburse the Guest the nightly rate + tax of each night deemed uninhabitable due to system failure (electricity, water, natural gas only). Evictions will result in no monies refunded. Host may cancel this Agreement and refund Guest in full if the Property becomes unavailable for nonperformance by the Host or Owner prior to check-in. Once Guest checks in, there shall be no refunds of rents because of shortened stays, lower occupancy than expected, ruined expectations, Amenity or Appliance malfunction, early departures due to work and family emergencies, unavailability of any or all parts of the Property, or any other reasons.
Guest understands that the Property is based upon an internet advertisement. The internet advertisement descriptions and photos are substantially accurate. However, it is the Renter's responsibility to confirm at time of booking that the home has the location, views, quality, amenities and sleeping arrangements to meet their needs. Host does not offer any warranty or "see if you like it" satisfaction guarantee.
Guest shall inform Host in writing at firstname.lastname@example.org of Renter’s intention to change or cancel the Reservation at any time. Adjustments in nightly rental rate may apply when reducing or adding to the total number of nights in the Reservation. For reservations made through third parties, additional cancellation policies may apply. Cancellations or Reservation changes due to illness, military, or extenuating circumstances will be arranged on a case-by-case basis.
The cancellation and change policy is as follows:
- Notice of cancellation or Reservation change 61 or more days prior to Reservation: full refund within 7 days of written receipt of cancellation.
- Notice of cancellation or Reservation change 31 - 60 days prior to Reservation: $250 Reservation change fee forfeited from Property Deposit. The balance will be refunded within 7 days of written receipt of cancellation.
- Notice of cancellation or Reservation change 0-30 days prior to the check-in date: full booking amount (rent, taxes, and Additional Services if pool/spa has started heating) will be forfeited. The Security Deposit and any pre-collected cleaning fees will be refunded within 7 days of written receipt of cancellation.
While Host has no obligation to return any portion of a forfeited fee, as a courtesy to our Guests, if Host is able to re-book any portion of the canceled reservation, Guest will be refunded the amount of the new Reservation, not to exceed the original booking amount + taxes.
HOST CANCELLATION POLICY: Host may cancel this Agreement and refund Guest in full if the Property becomes unavailable for any reason prior to check-in. Guest agrees that any claims against Host arising out of performance or non-performance under this Agreement shall be limited to a full refund of all funds previously tendered by Guest. Host has the option to offer Guest an alternative Property for the same Reservation dates and rate.
PACKAGES AND DELIVERY: Please contact Host prior to arrival if you plan on shipping anything to the Property before your scheduled arrival date. Items delivered after guest departure are subject to a minimum $35 re-directing fee + cost of mailing services. Customer assumes the risk of any package not being delivered and waives any claims against Host and Owner in the event any delivery is not completed on time, or at all.
CHECK IN: Check-in time is 4:00 PM (please take this into consideration when booking flights). Prior written approval is required from Host, 4 days minimum prior to arrival, for early check-in and costs $25 per hour + tax, 4-hour maximum. Once requested, there are no refunds for early check-in regardless of actual check-in time. Entry code to the home will be provided 48 hours prior to arrival for home and renter safety, if all fees and charges have been collected. If, for some reason, the home is not ready for check-in, you will be notified via text or email. Please do not attempt to check-in or visit the home prior to approved time.
Guest is required to perform a thorough walk-through of the Property within 2 hours of check-in and report damages/items in need of attention to Hosts in a group message at (623)217-1719 and (480)215-4411. This will help ensure the Property is up to Guest satisfaction. Guest accepts liability of any and all damages/items in need of attention that were not reported to Hosts within 2 hours of check-in.
Host makes every effort to have the Property ready for Guest Reservations but unforeseen circumstances or unauthorized late check-outs may occur. Guest acknowledges and accepts that the cleaning team may still be preparing the Property for occupancy from 4pm – 8pm. Host reserves the right to ask the Guest to leave the Property and return once the Property is ready. In most circumstances, the Guest is welcome to use the home and its amenities while the cleaning team is preparing the home.
CHECK OUT: Check out time is 10:00 AM (please take this into consideration when booking flights). Prior written approval is required from Host 4 days minimum prior to departure for a late check-out and costs $25 per hour + tax, 3-hour maximum. Once requested, there are no refunds for late check-out regardless of actual check-out time. A check-out checklist has been made available to the Guest on Property and via email. If you do not have time or fail to complete the checkout list, a $100 minimum fee will be deducted from your Security Deposit. For unapproved late check-outs, a minimum $75 per hour fee will be charged for each hour past the required check out time. In addition, Guest will be liable for any additional charges incurred, including but not limited to, the cost of supplying alternative accommodations for arriving guests and re-scheduling fees incurred by the cleaning team. If Guest fails to vacate the property on time, the Guest may also be charged an additional night as penalty, without any right to inhabit the Property during that additional time.
PREFERRED SERVICE UPGRADE: $125 for groups of 1-5 // $150 for groups of six to 12 // $200 for groups of 13 – 20 // $250 for groups larger than 20
- 3:00pm check-in (from 4:00pm)
- 11:00am check-out (from 10:00am)
- Additional paper products, extra pool towels, large quantity shampoo/conditioner/body wash, and 1 propane tank delivered to the Property prior to Reservation.
OCCUPANCY: Only the number of Guests listed on the Guest Agreement may occupy the Property, no subletting permitted. Authorization for additional day-time or night-time Guests must be requested and approved in writing by Host. Additional fees may be assessed for additional and unauthorized Guests, please abide by the maximum occupancy number for the home at all times. All events must comply with all community, local, city, state and federal governmental ordinances and laws. NO event shall generate noise, traffic or debris in excess of or for hours beyond those normally expected for the type and nature of the community in which the Property is located. Unauthorized parties or events will result in a minimum $1,000 fine in addition to the cost of any assessments, fines, or complaints imposed upon Property, Owner, and/or Host. No more than two people over age four (4) may occupy a king or queen bed.
QUIET HOURS: This Property is in a quiet residential neighborhood. Quiet time is from 9:00pm until 8:00am, or otherwise required by city law and/or the rules of the homeowner association (if any). Guest agrees not to participate in any activities that interfere with the neighbors' right to quiet enjoyment of their property. Guest agrees to fully comply with local noise regulations and to use common sense in keeping noise volume low to off after dark. Any enforcement actions by local law enforcement and/or homeowner’s association are at the Guest’s sole risk and expense; and may result in additional charges or immediate eviction without refund of any Reservation costs or fees.
- Disturbing the peace of the neighborhood
- Willful or accidental damage to the property
- Any occupancy level not disclosed on the Guest Agreement, including but not limited to excessive occupancy
- Violent, aggressive, confrontational, or threatening behavior or conversation to neighbors or any person associated with Host
- Consuming illegal substances on Property
PRIVATE PROPERTY: Guest acknowledges that the Property is a privately-owned home as opposed to a hotel. As such, hotel-like amenities such as daily cleaning and bell service are not provided. Additional Services can be requested with advance notice at an additional cost.
THERMOSTATS: Indoor heating/cooling units and pool heaters cannot be adjusted by anyone except management. The Guest may adjust the indoor thermostats up or down within the allowed range (72 degree minimum in Summer and 78 degree maximum in Winter). If it has been determined by Host that any of the home's thermostats have been tampered with, or there is damage to the units due to tampering, Guest accepts all liabilities for damages incurred during Reservation. Guest accepts that there will be a minimum charge of $200 withheld from the Security Deposit until exact days of tampering are determined. If you find that the thermostats are not working properly or preset incorrectly, please call 623-217-1719 or 480-215-4411. We will send someone to the home to fix the problem as quickly as we are able. Host utilizes licensed HVAC professionals for repairs and services, Host does not have control of professional schedules but will make every effort to schedule repair within 24 hours. Host agrees to reimburse the Guest the nightly rate + tax of each night deemed uninhabitable due to system failure (electricity, water, natural gas only), NOT due to Guest tampering or negligence.
AMENITIES: Furnishings and Amenities are not new and may exhibit signs of wear and tear. Amenities and furnishings are subject to change and may or may not be the same as pictured due to replacement, substitution, damage, etc. Since a limited supply of single-use items are provided, Guest should plan to replenish these items if necessary. Towels and linens are not to be removed from the Property. Guest is not responsible for replacing supplies used during Reservation.
Host provides the following, in addition to the fully furnished Property:
- One towel set (body towel, washcloth) per Guest on Agreement
- Ready-made beds
- 1 toiletry set (shampoo/conditioner combination, bar soap) per Guest on Agreement
- Hand soap, 2 toilet paper rolls, and hand towels in each bathroom
- 2 hairdryers
- Fully equipped kitchen (inventory list available upon request)
- Starter kit of laundry pods, dryer sheets, dish soap, and dish pods (1/night of Reservation)
REPAIR AND SERVICE CALLS: Host does not guarantee against mechanical or electrical failure of air conditioning, fans, lights, televisions, VCRs, DVDs, or other equipment. Host agrees to make every effort to have maintenance done quickly and efficiently but does not guarantee timely repair. Should a repair person conclude that equipment is in working order, or that failure was due to the actions of the Guest, then Guest agrees to pay the service call charge in full.
All toilets are checked to ensure proper functioning prior to check‐in. Do not flush hygiene products, sanitary napkins, wipes, or paper towels. If a service call is required to clear a toilet blockage, Guest will be charged all costs associated with clearing the blockage. The minimum service call fee is $200.00 for toilet blockages on weekdays and $400.00 on weekends and holidays. PLEASE USE PLUNGER PRIOR TO INITIATING A SERVICE CALL.
PETS: Dogs are permitted with prior written approval from Host. There is a $250 non-refundable pet deposit per pet, per stay. Guest agrees that there shall be no animal waste on driveway, hardscape, deck, patio, or any other person’s property. All animal waste must be picked up from Property daily and prior to check out to avoid damage to lawn, spreading of diseases, and/or unsanitary home. Any animal waste remaining after check-out incurs a minimum penalty of $75 and shall be immediately deducted from the Security Deposit.
SMOKING: Smoking of any type is strictly prohibited inside the home. Smoking is only allowed outside on the patios and yard, but not on patio furniture. Failure to clean all cigarette butts will results in a minimum of $100 deducted from Security Deposit. Please dispose of ALL substances prior to departure. Federally prohibited substances and/or paraphernalia is prohibited on all Properties and is cause for immediate eviction and loss of Security Deposit.
PARKING: Guest agrees to not exceed the maximum number of vehicles allowed on Property per arrival instructions (sent via email prior to arrival). All vehicles must be parked in the home's garage with the garage door closed, additional cars must be in the driveway. On-street parking is strictly prohibited. Authorization to park more than allotted number of vehicles on the Property must be obtained in advance. RV's, boats, trailers, box trucks or passenger vans which hold more than 8 people or are longer than 16’ long require written approval from Host. Failure to obtain written approval will result in immediate eviction.
POOL USE AND CLEANING: Guest is aware of the inherent risks to persons and Property while occupying residences with pool/spa features. Pools and spas are cleaned and chemically treated once weekly. Scheduled pool/spa cleanings are not based upon specific check-in dates. In the case of adverse weather conditions such as high winds, dust, and rain, please use pool cleaning equipment (net, brush) provided between scheduled cleanings. Do not touch any Amenities or equipment associated with pool/spa heaters, valves, or pumps. Guests restricting pool cleaner access to Property is a minimum fee of $100 deducted from the Security Deposit.
POOL/SPA HEATING: Properties equipped with a gas/electric pool and spa heater are heated upon request to a target temperature of 78 - 82 degrees, and the spa to a target temperature of 99 – 103 degrees. Guest agrees to pay $80 per day + tax for pool heat, $45 per day + tax for in-ground spa heat and $35 per day + tax for above ground spa heat. Heat is provided for the entirety of the Reservation, no partial days. There will be no refunds once the heaters are turned on for the Reservation. Considerations for partial refunds will be made due to mechanical failure (not a result of Guest tampering) of the pool/spa heater.
The Guest understands and accepts that climate conditions may prevent the pool from heating to the target temperature range during the Reservation. The guest is not to tamper with any pool equipment or accessories, other than the pool skimmer. If the pool equipment is found to be disturbed, Guest agrees to an automatic $250 deduction from Security Deposit or automatic charge to card on file. Please use thermometers provided to you to verify pool temperature and please let us know if pool is not heating to target temp with a photo of the thermometer.
Should Guest select no heat and change their mind during the Reservation, an additional $50 fee, minimum, will be due prior to a technician turning the heat on, paid via Zelle or Venmo.
WINTER USE OF WATER FEATURES: Waterfalls/water features are controlled by Host. Guest may request, but is advised against requesting, water feature use during October to May Reservations. Guest understands that the pool heating system will be turned off during water feature use, and pool heat payment will be forfeited. Host cannot have both units running during the winter months and will not guarantee optimal temperatures with water feature use.
HOME SECURITY: Guest is required to securely lock the premises when they are not on Property. Please lock all windows and doors EXCEPT GARAGE prior to departure.
PERSONAL (GUEST) PROPERTY: Owner shall not be responsible for damage or loss of Guest’s personal property. There will be a minimum $25.00 service charge plus shipping for any returned items. Host is allotted 14 days from departure to ship Guest belongings.
PRIVACY PROVISION: Host restricts access to Guest non-public personal information to employees and third parties, who need the information to provide customer service. Host agrees to maintain strict and universal confidentiality as to all provisions of this Agreement. Guest agrees that all photos or video taken of the Property are for private use only, and are not to be shared with any corporation or agency.
LANDLORD TENANT ACT: The occupancy of this Property, if less than 30 days, is considered transient and therefore not covered by the Arizona Residential Landlord and Tenant Act.
INDEMNITY AND LIMITATION OF LIABILITY: Guest agrees to release, indemnify, defend and hold harmless Host from all liability, claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage, or injury to Guests, their invitees, and Guest’s personal property. Guest hereby waives and releases any claims against Owner, Host, assignees, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest(s) or their invitees on or near the Premises, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility. In no instance or circumstance will Owner, Host, or affiliated representative be liable for more than the total Reservation amount paid by the Guest for the Reservation.
JURISDICTION: This agreement shall be governed by and construed in accordance with the laws of the State of Arizona. All disputes or claims pertaining to the Agreement shall be adjudicated in the State of Arizona, County of Maricopa.
