TERMS AND CONDITIONS

By providing my email address, without any response to AZ Vacation Home Concepts, LLC. in regards to these terms and conditions, I acknowledge that I have read and agree to abide by the conditions set forth in this rental Agreement and all policies, regulations, and rules set forth by Owner. I further understand and agree that to breach any items contained within the above referenced documents will result in my eviction without refund. I understand that Owner has made every effort to provide accurate information, however, in the event of errors, omissions, any changes by Owner, I agree not to hold Owner responsible or liable.

TERMS: The following definitions will apply: “Owner” refers to AZ Vacation Home Concepts LLC, a limited liability company duly organized and existing under the laws of the State of Arizona, having its administrative place of business at   AZ Vacation Home Concepts, LLC  P.O. BOX 11261  Glendale, AZ 85318.  “Renter” refers to the person or persons occupying the Property; and “Property” refers to the real property, its contents and related amenities rented to the Renter.

Our vacation homes are available for guests to enjoy and experience Phoenix, AZ. Please bear in mind that the home you reserve is located in a community with many year-round residents. In order to ensure the quality of our homes; and the peace and quiet of our neighborhoods, all occupants must adhere to the following Renter code of conduct and terms and conditions.  

Renter acknowledges that "Owner" is a licensed Real Estate Professional in the state of Arizona. 

BOOKING DEPOSIT/PAYMENT POLICY: A 50% Booking Deposit of the total Rental, Tax and Cleaning Charge is required to confirm the reservation by some booking sites, other sites require a 100% full payment. When offered, the balance, including the refundable property deposit, is due 60 days prior to arrival and returned with no damages/no mess/no additional charges to the property 14 days after departure. Any reservations made within 60 days of arrival are due in full to confirm the reservation. Full payment may be required at the time of booking for special events and holidays. (For example: Christmas, Easter and the month of March). Failure to pay remaining rental balances by due date will result in automatic cancellation of your reservation. Only 50% of your contract amount deposit will be refunded due to a non-payment cancellation. All special offers and discounted rates are paid in full at time of booking. We accept checks for U.S. funds, or credit cards (Visa, MasterCard, PayPal Venmo and Zelle). Cancellations due to COVID-19 will be arranged on a case-by-case basis.

The full deposit, if collected, will be returned within 14 days after your departure if there are no additional charges due or damage or excessive mess. All additional services must be paid in advance. If not paid in advance, all unpaid charges (see extra charges below), will be deducted from the property services deposit before it is returned OR a request for funds through Airbnb's Resolution Center, if a deposit was not collected.  A check-out list has been made available in this document and was e-mailed before check-in. If you do not have time or fail to complete the checkout list, $100 will be charged through Airbnb's Resolution Center (no exceptions). Please, NO tampering with pool equipment or indoor thermostats without permission, it can result in an additional charge up to $500 through Airbnb's Resolution Center. (Please call us at (623)217-1719 or (480)215-4411, we will be happy to help you). 

CHECK IN: Check-in time is 4:00 PM (please take this into consideration when booking flights). Early check-in only with prior written approval is $25 per hour. Please request early check in no less than 4 days in advance. Entry code to the home will be provided once all fees and charges have been collected and approximate (48 hours prior to arrival) for home and renter safety. If for some reason, the home is not ready for check-in you will be notified. Please do not attempt to check-in or visit the home prior to notification that the home has been cleared for check-in. Please notify Owner upon arrival so we may ensure the Property is to your satisfaction. Once requested, there are no refunds for early check-in regardless of actual check-in time. We make every effort to have the home ready by the 4 pm scheduled check-in time. 

CHECK OUT: Check out time is 10:00 AM (please take this into consideration when booking flights). Prior written approval is required from Owner for a late check-out and costs $25 per hour, 3-hour maximum. Cleaning and maintenance are pre-scheduled, so adhering to the check-out time is very important. For unapproved late check-outs, a $75/hour fee will be charged for each hour (or portion thereof) past the required check out time. Renter will be liable for any additional charges incurred, but not limited to the cost of supplying alternative accommodations for arriving guests and re-scheduling fees incurred by the cleaning team. If we are forced to use a different cleaning team due to a turnover, renter will be liable for the difference in the bill between traditional cleaning fee and actual amount charged. 

PREFERRED SERVICE UPGRADE: $125 for groups of 1-5 // $150 for groups of six to 12 // $200 for groups of 13 – 20 // $250 for groups larger than 20

EXTRA CHARGES: If not paid in advance all extra charges will be charged through your OTA's Resolution Center.

Departure cleaning fee $250-$500
Excessive trash: $65/hour it takes to collect trash and dispose of at dump + dump fee
Failure to complete checklist: $100
Pool and Spa heat (see pool terms below).
Early check-in: $25 per hour
Late check-out: $25 per hour (3 hour max) with approval
Unauthorized late check-out: $75 per hour without approval
$100 per extra twin bed for length of stay
$50 extensive BBQ grill cleaning/repair if damaged or left with additional cleaning required
Thermostat tampering: $500, temp shall not drop below 71 degrees
Unpaid extra nights for extended stay or early arrival date are charged the nightly rate. Once requested, there will be no refunds for these services.

THERMOSTATS: Indoor heating and cooling units and pool heaters are equipped with thermostats that are preset by management. The renter may adjust the indoor thermostats up or down within the allowed range (75 degrees maximum for winter heat, and a minimum of 72 degrees for summer cooling).  Pool heater thermostats are preset and cannot be adjusted by anyone except management. If it has been determined by our staff that any of the home's thermostats have been tampered with, Renter accepts that there will be a charge of $500 through Airbnb's Resolution Center. Damage to the AC units due to tampering will automatically jump to $500 charged through Airbnb's Resolution Center. If you find that the thermostats are not working properly or preset incorrectly, please call 623-217-1719 or 480-215-4411. We will send someone to the home to fix the problem as quickly as we are able.

CANCELLATION/REFUND POLICY: Renter shall inform Owner in writing at RESERVATIONS@AZVH.com of Renter’s intention to cancel the reservation. For reservations made through third parties, additional cancellation policies may apply. The cancellation policy is as follows:

If cancellation notice is received 60 or more days (60+) prior to the check-in date, a cancellation fee equal to $250, will be forfeited and the balance will be refunded within 7 days from receipt of written cancellation. If Cancellation notice is received less than 30 days (0-30) prior to the check-in date, the full booking amount of rent and taxes will be forfeited. The Security Deposit, if applied, and any pre-collected cleaning fees will be refunded within 7 days from receipt of written cancellation. As courtesy to our Renters, if Owner is able to rebook any portion of the canceled reservation, Renter will be refunded the difference of loss to the extent that Owner is able to re-book the Property.

Renter understands that the home rental is based upon an internet advertisement. The internet advertisement descriptions and photos are substantially accurate. However, it is the Renter's responsibility to confirm at time of reservation that the home has the location, views, quality, amenities and sleeping arrangements to meet their needs. We do not offer any warranty or "see if you like it" satisfaction guarantee.

OWNER CANCELLATION POLICY: In the unlikely event that the Property becomes unavailable for any part of the tenancy for reasons "beyond the control of the Owner", Owner may cancel this Agreement and refund in full of unoccupied time to the Renter all payments made. Owner will assist in procuring similar alternative accommodation should this situation arise. Renter agrees that any claims against Owner arising out of performance, or non-performance under this agreement shall be limited to a full refund of all consideration previously tendered by Renter. 

If the substituted property rents for more for the same period of current home; or remaining period respectively, Renter will not have to pay any additional charges. If the substitute property rents for less for the same period, the difference will be refunded to the Renter. In any event, the sole remedy for any perceived damages, liability, or inconvenience is a full refund of the rental amount upon Renter cancellation. It is highly recommended that Renter considers the purchase of travel insurance.    

CLEANING FEE: A clean house is our highest priority! If not paid in advance (see reservation payment confirmation for details), there will be a departure clean of $450-$700 (depending on total number of all guests that visit the home during your stay and condition of home at departure). It is recommended that a member of your group is available to meet our staff by 4pm. This will help ensure that the cleaning is to your satisfaction. We cannot guarantee that a staff member can return after check-in for additional cleaning nor do we offer any refunds for cleaning.

One towel set for each guest and bed linens are provided. All guests five years of age or older must be assigned a bed. No more than two people over age four may occupy a king or queen bed.  Each Additional twin bed $100. 

After check-out, if the Renter has not completed the checkout list, there will be an additional $100 charged through Airbnb's Resolution Center (no exceptions).

All trash must fit in trash bins. Trash that does not fit into bins, must be disposed by Renter at their own expense. There is a $50 charge to remove extra trash.

ARRIVAL/DEPARTURE: Check-in time is after 4:00 p.m. Check-out time is 10:00 a.m. Early check-in or late checkout is $25/hour. Early or late check-outs are only based upon availability. Please confirm availability with staff 4 days before you arrive to confirm an early check-in is possible. Once requested, there are no refunds for early check-in regardless of actual check-in time. We make every effort to have the home ready by the scheduled check-in time. Because we do not know the condition of the home before we take possession from the previous guest; and cannot guarantee the previous guest will depart on time, the customer acknowledges and accepts that the staff may still be working from 4pm – 8pm to prepare the home for their arrival. Owner reserves the right to ask the guest to leave the property and return once the property is ready. In most circumstances, the customer is welcome to use the home and its amenities while the staff is still preparing the home.

OCCUPANCY: Only those individuals who are listed on the Renter Information form may occupy the property.  Authorization for additional day-time or night-time guests above the home’s occupancy must be requested and approved in writing by owner. Additional fees may be assessed. All parties or “get-togethers” must be approved in writing by owner.

OTHER OCCURANCES: Owner does not accept liability for any loss or damage caused by, but not limited to the following: weather conditions, natural disasters, pests, construction disturbances, acts of God, or other reasons beyond its control. There shall be no refunds of rents because of shortened stays, ruined expectations, or departures due to work and family emergencies, unavailability of any or all parts of the Property, or any other reasons. 

There will be no refunds due to a "malfunction of an amenity or appliances". These appliances may include, but are not limited to: all pool equipment and heaters, indoor or outdoor spas, and kitchen appliances. Should the entire property become unavailable due to a loss of any basic utility (electricity, water, natural gas only), the owner may at their sole discretion substitute the owner's best available accommodations for the same period, or offer a refund only for the unavailable days. Loss of any utility due to weather, or any other act of nature will not be entitled to a refund. It is highly recommended that Renter considers the purchase of travel insurance.    

QUIET HOURS: The Rental Property is located in a quiet residential neighborhood. Quiet time is from 9:00pm until 8:00am, or as may otherwise be required by City Law and/or the rules of the homeowner association (if any). Renter agrees not to undertake any activities that interfere with their neighbors' right to quiet enjoyment of their property. Renter agrees to fully comply with local noise regulations and to use common sense in keeping noise volume low after dark. Any enforcement actions by local law enforcement and/or homeowner’s association are at the Renter’s sole risk and expense, and may result in additional charges or immediate eviction without refund of any deposits or rents.

BEHAVIOR: The Renter agrees to be responsible for the actions of themselves, other occupants, and temporary guests. By accepting and/or reading this form without written communication, the Renter agrees to act with decorum and civility always, and to be responsible for the Renter's guests and other occupants with respect to this requirement. The Renter understands and accepts that the Owner of the property retains sole discretion and may terminate the Renter's occupancy of the home if the Owner determines that either the Renter or any member of the Renter's group has acted inappropriately. If the Renter's occupancy is terminated due to inappropriate behavior, the Renter understands and accepts that no compensation, reimbursement, or refund will be made to the Renter. Examples of inappropriate behavior include but are not limited to: 

EXTENSION: The length of your stay may be extended subject to availability; however, there will be additional rental charges, taxes, and cleaning fees collected prior to extension start date in order to confirm extension.

REDUCTION: All reductions in your length of stay must be submitted in writing more than 60 days prior to arrival, and are subject to a minimum stay. Adjustments in nightly rental rate may apply when reducing the total number of nights rented. Reductions in your length of stay made 0-60 days prior to arrival will not result in a refund or reduction of rent and taxes.

CHANGE: Any request to change dates will be based on availability and timeliness of the request. Requests made more than 60-days prior to arrival will be made without penalty and will require a $150 Reservation Change Fee for the administrative costs associated with modifying a reservation and notifying all parties involved. Change requests made 0-60 days prior to arrival will require Owner approval, a $150 Reservation Change Fee and if there is any reduction in the number of nights booked, Renter will not be eligible for a refund on those nights as the standard Cancellation Policy would apply, as shown above.

PRIVATE PROPERTY: Renter acknowledges that the accommodation is a privately-owned home as opposed to a hotel.  As such, hotel-like amenities such as daily cleaning and bell service are not provided. Additional services can be requested with advanced notice at an additional cost.

AMENITIES: The property is fully furnished, and includes ready-made beds, one set of bath towels per guest and an equipped kitchen. Furnishings and amenities are not new and may exhibit signs of wear and tear. Amenities and furnishings are subject to change and may or may not be the exact same as represented due to replacement, substitution or other reasons. Owner provides a starter kit of soaps, dish detergent, laundry soap, shampoo, toilet paper, paper towels, and other dispensable items. Since a "limited supply" is provided, Renter should plan to replenish these items if necessary. Towels and linens are not to be taken from the home. Renter is not responsible for replacing used supplies.

PROPERTY CONDITION: The home is inspected for cleanliness before your arrival and after your departure. Please report anything that is not in acceptable condition within 2 hours of your arrival. Anything not reported in that time frame will be deemed acceptable. At check-out, Renter must leave the property in tidy condition, similar to that at move in. Cleaning crews will handle all major cleaning of linens, towels, kitchens, floors and bathrooms. However, "excessive cleaning" will be billed at $50/hour and will be charged to the Renter.

REPAIR AND SERVICE CALLS: Owner does not guarantee against mechanical or electrical failure of air conditioning, fans, lights, televisions, VCRs, DVDs, or other equipment.  Renter agrees to report any inoperative items to Owner promptly, and Owner agrees to make every effort to have maintenance done quickly and efficiently.  Should a repair person conclude that equipment is in working order, or that failure was due to the actions of the Renter, then the charge for the service call will be billed to Renter, and Renter agrees to pay the charge. No refund or rent deduction will be made due to failure of such equipment.

TOILET BLOCKAGES: All toilets are checked to ensure proper functioning prior to checkin. Do not flush hygiene products, sanitary napkins or paper towels. Blockages can occur if too much toilet paper, tampons, and/or sanitary napkins, are put into the toilets. If a service call is required to clear a toilet blockage, Renter will be charged the costs associated with clearing the blockage. The minimum service call fee is $200.00 for toilet blockages. The minimum service calls on weekends and holidays cost $400. PLEASE USE PLUNGER PRIOR TO INITIATING A SERVICE CALL.

SECURITY DEPOSIT: A $1000 Security Deposit may be collected 60 days prior to arrival. Incidental deposits will be refunded within 14 days from the date of departure. Paying a Security Deposit does not relieve the Renter in any way from requirements stated in the rental agreement. Additional charges not covered by the Damage Protection will be charged through Airbnb's Resolution Center.

OCCUPANCY:  The Property is for the sole use as a "personal vacation residence for families and responsible adults". Occupancy is restricted to the number of people "listed at the time of booking". Renter acknowledges that they will personally occupy the Property for the entire length of stay and will not sublet. Renter shall not use the Property for any illegal or unlawful purpose, nor shall the Property be used in a fashion that disturbs or offends the neighbors. 

Maximum occupancy does not only refer to the number a home can sleep. This is also the number of people allowed in the home at any given time. It is determined by the licensing authority based on the number of exits in the home and fire safety evacuation plan. Some counties or HOA’s have codes that are strictly enforced. Please abide by the maximum occupancy number for the home at all times. 

PETS: Dogs are permitted with prior written approval from Host. There is a $250 non-refundable pet deposit per pet, per stay. Guest agrees that there shall be no animal waste on driveway, hardscape, deck, patio, or any other person’s property. All animal waste must be picked up from Property daily and prior to check out to avoid damage to lawn, spreading of diseases, and/or unsanitary home. Any animal waste remaining after check-out incurs a minimum penalty of $75 and shall be immediately deducted from the Security Deposit Pet Security Deposit shall be maintained as additional damage deposit, in the event pet-related damage or staining has occurred or excessive cleaning is required. In such case, you will be charged through Airbnb's Resolution Center

SMOKING: Smoking of any type is strictly prohibited inside the home and is only allowed outside, away from doors and windows, but not on patio furniture. Please remove all cigarette butts from all used containers and dispose into the trash cans after they have cooled off. If any smoke odor or residue is found inside the home, an automatic $2,000.00 fee will be charged to the guest and/or deducted to the Security Deposit. Please dispose of ALL substances prior to departure.  Federally prohibited paraphernalia is prohibited on all of our properties and is cause for immediate eviction and a charge through Airbnb's Resolution Center

PARKING: No more than three vehicles (5 for Casa de Cielo) can be parked on the premises at any time. All vehicles must be parked in the home's garage whenever possible. On-street parking is strictly prohibited. Authorization to park more than three vehicles on the premises must be obtained in advance. No vehicle longer than 16' is allowed on the premises under any circumstances. RV's, boats, trailers, box trucks or passenger vans which hold more than 8 people are strictly prohibited and will result in immediate eviction. Please contact us prior to travelling for any possible exceptions depending on your destination property.

POOL CLEANING: Pools and spas are cleaned and chemically treated "once a week". Scheduled pool/spa cleanings are not based upon your specific check-in date. Adverse weather conditions such as high winds and rain may cause the pool to become dirty in between scheduled cleans. Pool cleaning equipment is provided for you to clean the pool in between scheduled cleanings.   If you have any questions about how to clean the pool, please read the home manual. Do not touch pool heaters, valves, or pumps. If you have any questions on how to clean the pool, please call 623-217-1719 or e-mail us at info@azvh.com. Please do not turn down German, our pool cleaner, from servicing the pool. Rescheduling German is a fee of $100 and will be the responsibility of the Renter.

POOL/SPA HEATING: Homes equipped with a gas pool and/or electric pool/spa spa heater. The pool is heated upon request to a target temperature of 78 - 82 degrees, and the spa to a target temperature of 99 – 103 degrees. Renter agrees to pay $80/day per day for pool heat, $45/day for in ground spa heat and $35/day for above ground spa heat. Please use thermometers provided to you to verify pool temperature and please let us know if pool is not heating to target temp with a photo of the thermometer if possible. Thank you

If you select no heat and change your mind during your stay, there is a $35 charge to turn pool or spa heater on after your arrival. The Renter understands and accepts that it is impossible to predict what the temperature and weather conditions will be during their stay; therefore, it is impossible to know for certain that the pool will be heated to the target temperature range during any period of the Renter's stay. The Renter has been advised of the limitations of pool heaters. By accepting these terms and conditions, the Renter has accepted the possibility that the pool and spa may not be heated to the target temperature during any period the of the Renter's stay. Once the heaters are turned on for your stay, there will be no refunds for pool heat. Considerations for partial refunds will be made due to mechanical failure of the pool/spa heater.

WINTER USE OF WATER FEATURES: During the months of October through May the ambient outside temperature may be too cold to operate the water features and maintain a heated pool to the desired temperature, it is impossible for the pool equipment to sustain a warm pool while these features are in operation.  A guest may elect to have such features turned on during their stay but renter understands that the pool heater system will be turned off and they will forfeit their pool heat payment.  We cannot have both units running during the winter months.

HOME SECURITY: It is the responsibility of every guest to securely lock the premises when they are not at the home. This includes all the home's doors (including garage door) and windows. Please lock all windows and doors EXCEPT GARAGE prior to departure.

GUEST RESPONSIBILITY:  Renter must list all guests (day-time and overnight) on the Renter information form. If any guest of Renter does not agree separately and in writing to these terms and conditions, the Renter(s) listed on this agreement, understands, and accepts full legal and financial responsibility for any breach of the terms of this agreement by themselves or any other guest. This includes: all theft or damage of the home or its personal property, adherence to the home's privacy policy, pool safety guidelines and all other terms of this agreement.

PERSONAL PROPERTY:  Owner shall not be responsible for damage or loss of Guest’s personal property.  There will be a $25.00 service charge plus shipping for any returned items.

PRIVACY PROVISION: We restrict access to your non-public personal information to our employees and third parties, who need the information to provide customer service. We agree to maintain strict and universal confidentiality as to all provisions of this agreement. Renter agrees that all photos or video taken of the Property are for private use only, and are not to be shared with any corporation or agency. 

LENGTH OF STAY: The occupancy of this home, if less than 30 days, is considered transient and therefore not covered by the Arizona Residential Landlord and Tenant Act.

LIABILITY/INDEMNIFICATION:   Any liability and costs associated with Guest and their invitees’ behavior will be charged to the Guest, regardless of time after departure of notice (notice would be sent to Host via mail/email from HOA, city, police department, fire department, or neighbors). Guest authorizes Host to charge the card on file for any damages and/or injuries caused from their use or misuse of the equipment and furniture within the Property, including service charges and maintenance fees up to 200% of any repair or replacement cost. Guest takes full liability for code, criminal violations, or breach of this Agreement by themselves or any other Guest on Property. This includes theft or damage of Property, adherence to the home's privacy policy, if any, pool safety guidelines, if available, and all other terms of this Agreement.

Guest shall indemnify and hold harmless Landlord against and from any and all claims arising from Guest’s use of the Premises or from the conduct of its business or from any activity, work, or other things done, permitted or suffered by the Guest in, upon, or about the Premises, and shall further indemnify and hold harmless Landlord against and from any and all claims arising from any breach or default in the performance of any obligation on Guest’s part to be performed under the terms of this Lease, or arising from any act or negligence of the Guest, or any other officer, agent, employee, guest or invitee of Guest and from all costs, attorneys’ fees and liabilities incurred in or about the defense of any such claim. Guest upon notice from Landlord shall defend the same at Guest’s expense by counsel reasonably satisfactory to Landlord. Guest, as a material part of the consideration to Landlord, hereby assumes all risk of damage to property or injury to persons in, upon or about the Premises, from any cause other than Landlord’s gross negligence and Guest hereby waives all claims in respect thereof against Landlord. Guest shall give prompt notice to Landlord in case of casualty or accidents in the Premises.


Renter hereby waives and releases any claims against Owner, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Renter on or near or adjacent to the Premises, including any common facilities, activities or amenities. Renter agrees to use any such facilities or amenities entirely at the Renter’s own initiative, risk and responsibility.

This agreement shall be governed by and construed in accordance with the laws of the State of Arizona. All disputes or claims pertaining to the Agreement shall be adjudicated in the State of Arizona, County of Maricopa.

Limit of Liability: In no instance or circumstance will Owner or affiliated representative be liable for more than the total amount paid by the Renter for the booking.

By my acceptance through email or with my signature, without any response to AZ Vacation Home Concepts, LLC. in regards to these terms and conditions I acknowledge that I have read and agree to abide by the conditions set forth in this rental Agreement and all policies, regulations, and rules set forth by Owner. I further understand and agree that to breach any items contained within the above referenced documents will result in my eviction without refund. I understand that Owner has made every effort to provide accurate information, however, in the event of errors, omissions, any changes by Owner, I agree not to hold Owner responsible or liable.

 

THESE TERMS AND CONDITIONS HAVE BEEN SENT TO THE EMAIL I PROVIDED AZ VACATION HOME CONCEPTS PRIOR TO MY ARRIVAL.
